This website ("store.smartvesna.com") is operated by Smart Vesna Agricultural Technologies, operating under the Smart Vesna sub-brand, under the umbrella of IBBTech Industrial Control Engineering Core. Any user who visits the site, reviews products, makes a purchase, or uses it in any way ("User") is deemed to have accepted the Terms and Conditions set forth below in advance. This text constitutes a legal agreement between the parties.

1. DEFINITIONS

  • IBBTech Industrial Control Engineering Core.: The overarching brand and company structure.

  • Smart Vesna: A sub-brand of IBBTech AI Technologies.

  • Smart Vesna Agricultural Technologies: The company unit operating in the field of agricultural equipment under the Smart Vesna brand.

  • User: Refers to the natural or legal person who visits the site, reviews products, or makes a purchase.

  • Product: Physical agricultural equipment, accessories, and other related materials offered by Smart Vesna.

2. DECLARATION OF ACCEPTANCE

By visiting the site and/or purchasing products, the User declares that they have fully read, understood, and accepted these Terms and Conditions. Users who do not accept these terms must not use the site.

3. SCOPE OF SERVICE

Smart Vesna sells physical equipment in the fields of vertical farming and soilless agriculture. The products offered for sale are physical items and are shipped to the delivery address via cargo.

4. PRODUCT SALES AND DELIVERY

All products are offered for sale according to stock availability. For products that are out of stock or require special assembly, the delivery period may take up to 60 business days. For such products, product returns or refunds are partially or completely not accepted after payment.
After the order is confirmed, products are shipped via the cargo company to the delivery address provided by the user.
Delivery times are based on the periods specified on the product page.
Shipping processes and delays are the responsibility of the cargo company.
If the product is damaged or incomplete upon delivery, the User must contact Smart Vesna as soon as possible.

5. PRICING AND PAYMENT

Product prices are determined in Euros (EUR) and may also be displayed in Turkish Lira (₺) based on the current exchange rate.
The User may make payment in Euros or Turkish Lira.
Accepted payment methods: Credit Card, Bank Transfer/EFT, Digital Wallets, and other secure payment systems.
After payment is completed, the order is processed. For payments made by bank transfer, the bank account holder name must match the name of the user placing the order. Orders placed with different bank account details may be blocked or canceled. The person placing the order and the bank account details used for payment must be the same.

6. CANCELLATION, RETURN, AND EXCHANGE CONDITIONS

For physical products, users have a legal right of withdrawal within the scope of distance selling regulations.
The right of withdrawal can be exercised within 14 calendar days from the date of product delivery. For products that are out of stock or require special assembly, the delivery period may take up to 60 business days. For such products, product returns or refunds are partially or completely not accepted after payment.
Products to be returned must be in their original packaging, unused, undamaged, and accompanied by all their accessories.
The return process begins with Smart Vesna's approval, and the return conditions can be learned in detail on the site or through customer service.
Shipping costs are borne by the User in case of return, unless otherwise stated.
In cases of defective, damaged, or incorrect product shipment, the products are replaced free of charge or refunded by Smart Vesna.

7. WARRANTY AND LIMITATION OF LIABILITY

Products sold by Smart Vesna are covered by the manufacturer's warranty.
The warranty period and scope are specified on the product page.
The warranty does not cover damages resulting from misuse of the product, unauthorized interventions, or accidents.
Smart Vesna does not accept liability for direct or indirect damages arising from the use of products.

8. INTELLECTUAL PROPERTY RIGHTS

All software, images, logos, texts, and other materials found on the site content belong to Smart Vesna.
Unauthorized use, reproduction, and distribution are prohibited and will result in legal action.

9. PRIVACY AND PROTECTION OF PERSONAL DATA

Users' personal data is protected in accordance with KVKK and GDPR regulations and is not shared with third parties.

10. USER RESPONSIBILITIES

The User is obliged to keep their account information confidential and to provide accurate and up-to-date delivery information.
The User must refrain from misusing the site and engaging in unlawful conduct.

11. RIGHT TO AMEND

Smart Vesna reserves the right to make unilateral changes to these Terms and Conditions. The updated text becomes effective as of the moment it is published on the site.

12. EFFECTIVENESS AND DISPUTE RESOLUTION

This agreement becomes effective upon acceptance by the User.
In the event of any disputes between the parties, the courts and enforcement offices of Istanbul (Anatolia) shall have jurisdiction.
The laws of the Republic of Turkey shall apply.
